1. Acceptance of Terms
By accessing or using Claims Solutions CRM ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.
2. Description of Service
Claims Solutions CRM is a cloud-based software tool designed to assist with claims management workflows. The Software provides features including but not limited to claims tracking, document management, contract generation, client portals, and AI-powered analysis tools.
3. Software Provided "As Is"
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Claims Solutions does not warrant that the Software will be uninterrupted, error-free, or free of viruses or other harmful components.
4. Not Professional Advice
The Software is a workflow management tool only. Nothing in the Software constitutes legal, financial, insurance, medical, or other professional advice. Users are solely responsible for:
- Ensuring compliance with all applicable federal, state, and local laws, regulations, and licensing requirements
- Verifying the accuracy of all data entered into and generated by the Software
- Obtaining appropriate professional advice for legal, financial, and insurance matters
- Reviewing all contracts and documents generated by the Software before execution
5. AI Features Disclaimer
The Software includes AI-powered features such as hail detection, document analysis, and automated text extraction. These features provide estimates and suggestions only. They are not a substitute for professional inspection, assessment, or judgment. Users should not rely solely on AI outputs for making business, legal, or financial decisions. AI analysis results may contain errors or inaccuracies.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLAIMS SOLUTIONS, ITS DEVELOPER(S), AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Errors or inaccuracies in claim processing, document generation, or calculations
- Any reliance on AI-generated analysis, estimates, or recommendations
- Service interruptions, data loss, or security breaches
- Damages arising from third-party integrations (including Stripe, Cloudflare, or other services)
- Any action taken or not taken based on information provided by the Software
THE TOTAL LIABILITY OF CLAIMS SOLUTIONS FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7. Indemnification
You agree to indemnify, defend, and hold harmless Claims Solutions, its developer(s), and their affiliates from any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Software; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any claim that your use of the Software caused damage to a third party.
8. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must not use the Software for any unlawful purpose or in violation of any applicable regulations. You are responsible for backing up your data.
9. Subscription and Payments
Paid subscriptions are billed monthly through Stripe. You may cancel your subscription at any time through the billing portal. Refunds are not provided for partial months. Claims Solutions reserves the right to change pricing with 30 days' notice.
10. Data and Privacy
You retain ownership of all data you enter into the Software. Claims Solutions will not sell or share your data with third parties except as necessary to provide the service (e.g., payment processing via Stripe). See our Privacy Policy for details.
11. Termination
Claims Solutions may terminate or suspend your access to the Software at any time, with or without cause, with or without notice. Upon termination, your right to use the Software will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
13. Changes to Terms
Claims Solutions reserves the right to modify these Terms at any time. Continued use of the Software after any modification constitutes acceptance of the modified Terms.
